These Terms of Service ("Terms") govern your access to and use of TapMetrics, including our website, application, and related services.
By using TapMetrics, you agree to these Terms. If you do not agree, do not use TapMetrics.
1. About TapMetrics
TapMetrics is a customer check-in and source tracking tool for local businesses.
TapMetrics helps businesses track where customers came from and how often they return using a front-desk check-in flow.
TapMetrics is not designed for online-only ecommerce tracking, background location tracking, or advertising platform replacement.
2. Who May Use TapMetrics
You may use TapMetrics only if you are able to enter into a legal agreement and follow these Terms.
If you use TapMetrics on behalf of a business, you confirm that you have authority to bind that business to these Terms.
TapMetrics is currently intended for businesses located in the United States.
3. Accounts
You are responsible for maintaining the confidentiality of your login information.
You are responsible for all activity under your account.
You agree to provide accurate account and billing information and keep it up to date.
4. Subscriptions and Pricing
TapMetrics offers a paid subscription.
Current pricing may include:
- $19.99 per month
- $167.92 per year
Pricing may change in the future, but changes will not affect your current paid subscription term unless stated at renewal.
5. Free Trial
TapMetrics may offer a 14-day free trial.
At the end of the free trial, your subscription may automatically begin and your payment method may be charged unless you cancel before the trial ends.
Stripe Checkout and Stripe Billing may be used to manage trial and subscription billing. Stripe supports subscription checkout and free trial setups for recurring subscriptions.
6. Billing
Payments are processed through Stripe.
By subscribing, you authorize TapMetrics and Stripe to charge your payment method for recurring subscription fees, applicable taxes, and other charges related to your plan.
You are responsible for keeping your payment method current.
7. Cancellation
You may cancel your subscription through your dashboard or billing portal.
Cancellation stops future renewals. Unless otherwise stated, you will continue to have access to TapMetrics until the end of your current paid billing period.
Stripe provides customer billing portal tools that allow customers to manage and cancel subscriptions.
8. Refunds
Payments are generally non-refundable.
If you cancel after a monthly or yearly subscription charge, you may continue using TapMetrics until the end of the paid billing period, but we do not provide partial refunds or credits unless required by law.
9. Business Responsibilities
You are responsible for how your business uses TapMetrics.
This includes:
- Training staff on proper check-in use
- Making sure customer information is entered correctly
- Giving customers any notices required by law
- Getting any consent required by law
- Using customer information legally and responsibly
- Maintaining your own business records where required
TapMetrics provides software. It does not provide legal, accounting, tax, advertising, or compliance advice.
10. Customer Check-In Data
TapMetrics may collect customer phone numbers and check-in activity on behalf of your business.
You represent that you have the right to collect and use this information through TapMetrics.
You agree not to use TapMetrics to collect sensitive information that is not needed for basic check-in and source tracking.
11. Acceptable Use
You agree not to:
- Use TapMetrics for unlawful purposes
- Upload or enter false, misleading, or harmful information
- Attempt to access another user's account
- Interfere with the security or operation of TapMetrics
- Reverse engineer, copy, or resell TapMetrics without permission
- Use TapMetrics to send spam or unauthorized marketing messages
- Use TapMetrics to collect sensitive personal information unrelated to customer check-ins
12. No Guaranteed Results
TapMetrics helps businesses track customer sources and repeat visits.
We do not guarantee that using TapMetrics will increase revenue, improve advertising performance, bring in more customers, or produce any specific business result.
You are responsible for your own business decisions, advertising decisions, and customer relationships.
13. Service Availability
We work to keep TapMetrics available and reliable, but we do not guarantee uninterrupted service.
TapMetrics may be unavailable from time to time due to maintenance, updates, outages, security issues, or factors outside our control.
14. Changes to the Service
We may update, improve, modify, or discontinue parts of TapMetrics at any time.
We will try to avoid changes that materially reduce the value of the service for active subscribers, but we may make changes as needed for security, reliability, compliance, or product improvement.
15. Ownership
TapMetrics, including its software, design, branding, content, features, and technology, is owned by TapMetrics, LLC or its licensors.
These Terms do not give you ownership of TapMetrics.
You may not copy, modify, distribute, sell, or lease any part of TapMetrics unless we give written permission.
16. Your Data
You retain ownership of the business and customer data you enter into TapMetrics.
You give TapMetrics permission to use that data only as needed to provide, secure, support, and improve the service.
We do not sell customer check-in data.
17. Data Deletion After Cancellation
After cancellation, TapMetrics may retain account and check-in data for up to 30 days for support, recovery, or export.
After that period, we may delete or anonymize the data.
Backup copies may remain for a limited time, typically up to 90 days, before being deleted through normal backup rotation.
18. Third-Party Services
TapMetrics may rely on third-party services, including Stripe for payments.
Your use of third-party services may be subject to their own terms and policies.
TapMetrics is not responsible for third-party services we do not control.
19. Disclaimer
TapMetrics is provided "as is" and "as available."
To the fullest extent allowed by law, we disclaim warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranties arising from course of dealing or usage of trade.
20. Limitation of Liability
To the fullest extent allowed by law, TapMetrics, LLC will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, including lost profits, lost revenue, lost data, business interruption, or loss of goodwill.
To the fullest extent allowed by law, our total liability for any claim related to TapMetrics will not exceed the amount you paid to TapMetrics in the three months before the claim arose.
21. Indemnification
You agree to defend, indemnify, and hold harmless TapMetrics, LLC from claims, damages, liabilities, costs, and expenses arising from:
- Your use of TapMetrics
- Your violation of these Terms
- Your violation of law
- Your collection or use of customer information
- Your business operations
22. Termination
We may suspend or terminate your access to TapMetrics if you violate these Terms, fail to pay, create risk for TapMetrics or others, or use the service unlawfully.
You may stop using TapMetrics at any time.
23. Governing Law
These Terms are governed by the laws of the State of Texas, without regard to conflict of law principles.
24. Changes to These Terms
We may update these Terms from time to time.
If we make material changes, we may notify you by email, through the app, or by posting the updated Terms on our website.
Your continued use of TapMetrics after the updated Terms become effective means you accept the updated Terms.
